Texas Data Privacy & Security Act (TDPSA)

Texas privacy law with NO revenue or volume threshold - applies to most businesses serving Texas residents. Only SBA-defined small businesses are partly exempt.

Overview

Unusual among US state privacy laws: there is no 100K-consumer threshold. It applies to anyone doing business in Texas or selling products/services to Texans, unless they are an SBA-defined small business - and even small businesses must obtain consent before selling sensitive data. Requires a privacy notice, opt-outs (sale, targeted ads, profiling), and Global Privacy Control honoring. The Texas AG is actively enforcing.
